These official rules (“Official Rules”) apply to survey sweepstakes conducted by FASTPITCH BARN, LLC and/or its related entities (“Sponsor”) on behalf of itself and/or Fastpitch Barn, LLC and/or its related entities. Each such sweepstakes (individually and collectively, “Sweepstakes”) will be announced via an email or website pop up window or such other method as may be determined from time to time by Sponsor (“Sweepstakes Announcement”). A Sweepstakes Announcement will be delivered in the method determined by Sponsor to select, intended recipients and will include the applicable methods of entry, entry deadline, drawing date, prize(s)/value(s) and a link to these Official Rules. All information contained in a Sweepstakes Announcement is incorporated herein by reference.

ELIGIBILITY: OPEN ONLY TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES AND THE DISTRICT OF COLUMBIA, WHO ARE AT LEAST 18 YEARS OF AGE AND THE DIRECT AND INTENDED RECIPIENT OF THE SWEEPSTAKES ANNOUNCEMENT. VOID OUTSIDE THE AREA STATED AND WHERE PROHIBITED. Employees and other workers, including temporary employees, freelancers and independent contractors (and their immediate families (parent, child, spouse or sibling and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related) of Sponsor, its parent, affiliates, subsidiaries, sponsors, promotional partners and advertising and promotion agencies are not eligible to enter or win. By participating, entrants agree to be bound by these Official Rules and the decisions of Sponsor, which are binding and final on matters relating to each Sweepstakes. Each Sweepstakes is subject to all applicable federal, state and local laws.

HOW TO ENTER: There are one (1) ways to enter a Sweepstakes. 1) Survey Completion: prior to the entry deadline for the applicable Sweepstakes, click through the survey link in the applicable Sweepstakes Announcement, answer the survey question(s) and complete and submit the Sweepstakes entry form in its entirety to be entered for a chance to win. (1) entry per person/email address/household per Sweepstakes, regardless of method of entry. Multiple entries received from any person or email address or household will be void. Entries generated by script, macro or other automated or mechanical means or by any means which subvert the entry process will be void. All entries become the property of Sponsor and will not be acknowledged or returned.

DRAWING(S)/WINNER NOTIFICATION: Potential winner(s) will be selected in a random drawing from all eligible entries received, and notified by mail, phone, and/or email within ten (10) days following the conclusion of the applicable Sweepstakes. Odds of winning depend on the number of eligible entries received for the applicable Sweepstakes. Potential winner(s) may be required to execute and return an affidavit of eligibility, a liability release and, where lawful, a publicity release within the time period specified by Sponsor. As applicable, if such documents are not returned within the specified time period, the prize notification is returned as undeliverable, or a potential winner is not in compliance with these Official Rules, then such potential winner will forfeit their prize and, at Sponsor’s discretion, an alternate winner may be selected, time permitting. If a potential winner is at least 18 but still considered a minor in their jurisdiction of residence, such potential winner’s prize may be awarded in the name of their parent or legal guardian, who will be responsible for fulfilling all requirements imposed on winners as set forth herein.

PRIZE(S): The number and approximate retail value of prizes awarded in any Sweepstakes will vary and will be set forth in the Sweepstakes Announcement. Prizes include only what is specified in the prize description. Prizes are awarded “as is” with no warranty or guarantee, either express or implied. Prizes may not be substituted, transferred, assigned or redeemed for cash except at Sponsor’s sole discretion. Sponsor reserves the right, in its sole discretion, to substitute a prize (or portion thereof) with one of comparable or greater value. Certain prizes may be concert/event tickets and/or be awarded as gift cards, gift certificates or vouchers, all of which shall be subject to the terms and conditions printed thereon. Potential winners of concert/event tickets must be available to attend such concert/event on the date specified or a alternate winner may be selected by Sponsor, and seat locations will be determined by Sponsor, if and as applicable. A potential winner of concert/event tickets who is considered a minor must attend such concert/event with minor’s parent or legal guardian or other adult as authorized by the minor’s parent or legal guardian. Winners and, if applicable, winners’ guest(s), must comply with all venue rules and regulations. Failure to do so may result in forfeiture of prize in its entirety. Sponsor will not consider or fulfill any requests for additional or alternate prizes, including but not limited to requests for additional tickets, upgrades and/or alternate dates or seating. Winners are responsible for all applicable federal, state and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided. Unless otherwise stated in the Sweepstakes Announcement, travel, meals, accommodation or any other costs associated with prize acceptance and use are not included as part of prize and are the sole responsibility of the winner. If any prize-related concert/event is cancelled or postponed or any prize or prize component cannot be provided by Sponsor for any reason, the terms of the ticket shall govern (if and as applicable) and Sponsor will have no further obligation to winner, and no compensation or substitution will be provided; however, if applicable, the remainder of prize package will be awarded. All prize details are at Sponsor’s sole discretion. With respect to any Sweepstakes governed by these Official Rules, there is a limit of one (1) prize per person/email address/household in any ninety (90) day period.

LIMITATION ON LIABILITY: ENTRANTS (AND, IN THE CASE OF ELIGIBLE MINORS, THEIR PARENTS OR LEGAL GUARDIANS) RELEASE, DISCHARGE, AND AGREE TO INDEMNIFY AND HOLD HARMLESS SPONSOR, AND ITS MEMBER TEAMS FOR OUR  PROMOTIONS; EACH OF THE APPLICABLE SOCIAL MEDIA PLATFORMS; PRIZE SUPPLIERS; AND ALL OF THEIR RESPECTIVE PARENTS, AFFILIATES, SUBSIDARIES, SPONSORS, PROMOTIONAL PARTNERS AND ADVERTISING AND PROMOTION AGENCIES AND ALL OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, PARENTS, SUBSIDIARIES, AFFILIATES, AGENTS, AND REPRESENTATIVES (COLLECTIVELY, THE “RELEASED PARTIES”) FROM AND AGAINST ANY LIABILITY FOR ANY DAMAGES, INJURIES OR LOSSES (INCLUDING DEATH) TO ANY PERSON OR PROPERTY OF ANY KIND RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY FROM ACCEPTANCE, POSSESSION, MISUSE OR USE OF ANY PRIZE (INCLUDING ANY TRAVEL OR ACTIVITY RELATED THERETO) OR PARTICIPATION IN ANY SWEEPSTAKES-RELATED ACTIVITY OR PARTICIPATION IN ANY SWEEPSTAKES CONDUCTED BY SPONSOR.

PUBLICITY GRANT/DATA COLLECTION: Except where prohibited by law or regulation, by entering a Sweepstakes and/or accepting a prize, each entrant (and, if an eligible minor, entrant’s parent or legal guardian) grants Sponsor and its successors, assigns, licensees and designees permission to use entrant’s name, address (city and state), photograph, voice and/or other likeness, and/or prize information, in any and all media now known or hereafter discovered (including, without limitation, on Sponsor’s websites and via Sponsor’s social media accounts), in any manner, worldwide in perpetuity, for any purpose in reference to a Sweepstakes, without additional compensation, consideration, notification, review or consent.  Sponsor reserves the right to use any entry or response or comments made by an entrant, in whole or in part, in any and all media now known or hereafter discovered (including, without limitation, on Sponsor’s websites and via Sponsor’s social media accounts), in any manner.

GENERAL CONDITIONS: Illegible, inaccurate, damaged, misdirected, delayed, unintelligible or incomplete entries, messages, comments, posts or responses will be disqualified. The Released Parties are not responsible for any lost, late, misdirected, stolen or undelivered entries. The Released Parties are not responsible for lost, interrupted or unavailable network, server, Internet Service Provider (“ISP”), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes and/or potential winner(s) or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to entrants’ or to any other person’s computer related to or resulting from participating in any Sweepstakes or downloading materials from or use of any applicable Sweepstakes-related website or any social media platform. Persons who tamper with or abuse any aspect of any Sweepstakes or any applicable Sweepstakes-related website or any social media platform or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. In the event that technical or other circumstances compromise a Sweepstakes (including, without limitation, a computer virus, bugs, tampering, unauthorized intervention, technical failures, insufficient volume of eligible entries), Sponsor reserves the right, in its sole discretion, to cancel, modify or terminate the Sweepstakes, and/or to select winner(s) for prize(s) from all eligible entries received prior to the cancellation based on the applicable winner selection methods described in these Official Rules or as otherwise deemed fair and appropriate by Sponsor. In the event of a dispute as to any entry or the identity of an entrant, entries will be declared to be made by the authorized account holder and natural person assigned by (i) an ISP to the email address associated with the entry or (i) the social media platform to that social media platform account associated with the entry, and they must comply with these Official Rules. Entrants may be required to show proof of being the authorized account holder. ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF A SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
